Welcome to Kids Nest Hub (“Kids Nest Hub,” “we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your access to and use of https://kidsnesthub.com/ (the “Site”) and any purchases of products (“Products”) made through it. By visiting the Site, creating an account, or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site.
1. Eligibility
U.S. customers only. We currently ship within the United States and its territories.
Age requirement. You must be at least 18 years old—or an emancipated minor—to purchase Products. If you are under 18, you may use the Site only with the involvement of a parent or legal guardian.
2. Account Registration
You may browse without registering, but certain features (e.g., order history, wish lists) require an account. You are responsible for maintaining the confidentiality of your login credentials and restricting access to your device. All activities under your account are your responsibility.
3. Product Information & Availability
We strive to display accurate descriptions, images, and pricing. However, colors may vary by monitor/device, and availability is subject to change without notice. We reserve the right to limit quantities or cancel orders at our sole discretion.
4. Pricing & Payment
Prices are listed in U.S. dollars and exclude taxes, shipping, and handling unless stated otherwise. We accept major credit cards, debit cards, PayPal, Apple Pay, and Shop Pay. By submitting payment information, you represent that you have the legal right to use the form of payment selected.
5. Order Acceptance & Cancellation
Your receipt of an electronic or other order confirmation does not signify our acceptance of your order. We may accept, decline, or place limits on your order for any reason, including suspected fraud, inventory issues, or violations of these Terms. You may cancel an order prior to shipment by contacting Customer Care at contact@kidsnesthub.com.
6. Shipping & Risk of Loss
Shipping options, costs, and estimated delivery times are provided at checkout. Title and risk of loss transfer to you upon our delivery to the carrier. We are not liable for shipping delays caused by carriers or events outside our control.
7. Returns & Refunds
Return window. Unused, unopened Products may be returned within 30 days of delivery for a full refund of the purchase price (excluding original shipping fees).
Return condition. Items must be in original packaging with all accessories, manuals, and tags.
Non-returnable items. Clearance items marked “Final Sale,” digital gift cards, and personalized Products cannot be returned unless defective.
Process. Contact Customer Care for an RMA (Return Merchandise Authorization) and prepaid label. Refunds are issued to the original payment method within 7 business days of receipt and inspection.
8. Safety & Compliance
Our toys meet or exceed all applicable U.S. safety standards, including the Consumer Product Safety Improvement Act (CPSIA). Follow age-grading, assembly instructions, and safety warnings included with each Product. Misuse voids any warranty and may result in injury.
9. Intellectual Property
The Site and its content—logos, graphics, photos, videos, product names, and software—are owned or licensed by us and protected under U.S. and international intellectual-property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
10. User-Generated Content
If you post reviews, photos, or other content (“UGC”), you grant us a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, adapt, publish, and display that UGC in any media. You represent that you own or control all rights to your UGC and that it does not violate any law or infringe third-party rights.
11. Disclaimer of Warranties
Except as expressly stated, the Site and Products are provided “as is” and “as available,” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Some states do not allow limitations on implied warranties, so the above may not apply to you.
12. Limitation of Liability
To the fullest extent permitted by law, in no event shall the Company, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or Products, even if advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid for the Product giving rise to the claim.
13. Indemnification
You agree to defend, indemnify, and hold harmless the Company from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, violation of law, or infringement of third-party rights.
14. Governing Law & Dispute Resolution
These Terms and any disputes are governed by the laws of the State of Delaware, without regard to its conflicts-of-law principles. Any dispute that cannot be resolved informally will be submitted to binding arbitration under the Consumer Arbitration Rules of the American Arbitration Association. You waive the right to a jury trial and to participate in class actions.
15. Severability
If any provision of these Terms is found unlawful or unenforceable, that provision will be deemed severed and the remaining provisions will remain in full force.
16. Changes to Terms
We may update these Terms at any time. Changes become effective when posted on the Site with a revised “Last updated” date. Continued use after changes constitutes acceptance.
